Agreed. There is an excellent recent chapter by Bill Swadling entitled “treehold” about the law in England and Wales. It includes some Scottish case law, but we could do with a Scottish version. bloomsbury.com/uk/modern-stud…

It is difficult to see how a house swap could be ‘in the course of business’ as businesses are not in the habit of swapping houses. It is also interesting that the updated guidance is introduced by the word “Errata”. gov.scot/publications/s…

This an extremely cool annual publication, profits from which which fund PhD scholarships in Scots private law: a brilliant example of investing in the future of the discipline.

This is an interesting piece about planned reform to allow for termination of joint private residential tenancies (in the new Housing (Scotland) Bill). Andrew Steven and I offered some comments on an earlier piece by these solicitors at Gillespie Macandrew and this is the update.

At end of the 23/24 marking season , it's obvious this year is going to go down as the year essays in traditional sense became a useless mode of assessment. Much of the academic discourse is driven by elite voices with students capable of using ChatGPT as turbo search engine 🧵

Not nearly my area of law - but quite interesting. Change impending in the laws dealing with taking security over Scotch whisky, for all bottle and cask collectors out there... dlapiper.com/en/insights/to…

One thing that I feel we are not perhaps as clear in explaining in teaching as we could be in law is the importance of procedure. There is a temptation to view it as practice related with minimal doctrinal input but it shapes argument in cases and consequently decisions.

Tuition fee discourse again in scotland. Any discussion should consider that as a result of the policy we cap places for domestic students, scottish students ending up leaving scotland, and student maintenance is not great. Every decision has consequences.
