Shocking for a Senator to claim just 6% of federal workers are "back at work." I looked it up. What the OMB study actually said was that (excluding 10% who are fully remote) federal workers spend 79.4% of their time in the office, compared 61.2% for telework-eligible workers.

Different messages from GOP Senators. In the hallways, they're talking about the need for Democrats to cooperate and approve Trump nominations. On the Senate floor, the GOP is about to start parliamentary delaying tactics to stall Biden judicial picks.

Reminder that INS v. Chadha killed the legislative veto and we are still feeling the downstream effects of not being able to setup laws so that Congress can nullify executive actions by concurrent resolution.

Together with Zachary Liscow and Niskanen Center, I'm organizing a conference on the Law of Abundance. Please submit an abstract (due Feb. 14) for possible selection -- and help us get the word out!

1/ In anticipation of the impoundment brawl-to-be, I highly recommend going back to the Supreme Court's 1997 decision striking down the line-item veto--which was essentially a limited impoundment power that Congress had given to the president. SCOTUS wasn't having it.

A couple observations: (1) It's interesting that DOJ only expressly mentions the FTC, NLRB, and CPSC. It will no doubt extend the same position to some others. But the MSPB is one I'm curious about, as there are stronger arguments there that the agency is largely adjudicative.

"By seeking to combine two mismatched categories, the executive order misuses RIFs, misunderstands shutdown plans, and introduces political manipulation into what is meant to be an orderly process for winding down unneeded positions," writes Bridget C.E. Dooling.
