Alert,In Constitutional Petition No.40 of 2015 (CEPILvAttorney General),the Constitutional Court (June 2025) tackled the balance between the #Subjudice rule .The Court ruled that Parliament’s oversight cannot be blocked simply because a matter is before the courts. #RuleOfLaw.

The Court held that while the sub judice rule protects fair trials, it cannot be a tool to silence Parliament or shield public officials from scrutiny. Rule 73 of Parliamentary Procedure restricting debate on sub judice matters was declared unconstitutional. #GoodGovernance.

Justice Mugenyi emphasized: “The legislature must be allowed to enjoy its independence… A matter being in court should not deter Parliament from fulfilling its oversight mandate.”A vital win for democracy, transparency, and free expression in Uganda. #CEPIL #Justice #HumanRights
