Nice piece by Noah Feldman. Is a call for genocide allowed under free-speech rules? It really does depend on the context, argues Noah Feldman, even if all such calls are repugnant bloomberg.com/opinion/articl… via Bloomberg Opinion

I don't know how I missed this. Thanks Lawrence Solum for the "highly recommended, download it while it's hot" recommendation for my article "Diversity by Facially Neutral Means" -- which is here: papers.ssrn.com/sol3/papers.cf… and forthcoming from Virginia Law Review

Fred's work on generalization was so insightful, emphasizing that equality sometimes requires treating different things the same. His book "Profiles, Probabilities and Stereotypes" had a big impact on my thinking. Such a generous colleague and friend. I miss him already.
