What's worse, the scheme was enabled by an opinion from Giles Goodfellow KC. He should have known the scheme was fraudulent. He certainly shouldn't have said the scheme worked as a matter of law We published the KC instructions/opinion here: taxpolicy.org.uk/2023/07/04/kc/

The question is whether we are going to see the Bar Standards Board take action against Mr Goodfellow and other barristers who've facilitated these structures, and whether HMRC will start prosecuting the ringleaders for fraud.

Dan Neidle So given that Zahawi the horse warmer engaged in his interesting approach to tax via a corporate entity how come that entity, and its directors, haven't been prosecuted? The approach they used clearly facilitated tax evasion so what have I missed?

Nathan Dennis 🇺🇦 Dan Neidle You are only missing (what you already know) that the government can operate in a very selective manner, and it tends to look after its own - even with differing political persuasions. After all - What one side can be prosecuted for is likely to be practised by the other side.
