Are free speech and racial equality at odds with one another? I explore that question in my review of a new book on the subject. (Short answer: No, but that doesn't mean we can't modify First Amendment doctrine to more fully realize the goal of racial equality.)

Lots to dislike in Bruen, but one of the biggest problems is requiring lower courts to conduct historical inquiries without any direction on how to do so. In Bruen, the Court cobbled together the supposedly relevant history from statements in the parties’ and the amici’s briefs.
