When it comes to issues about college athlete employees and their visas, I rely on Allan Wernick as my no. 1 source. Why? Because he’s been teaching, writing and working in immigration law for 30+ years. And, for many years, he ran a great immigration law center at The City University of New York.

I am getting ready to leave Germany, where “never forget” really means “never forget.” As I read tweets from colleagues endorsing a NYC mayoral candidate that denies Israel’s right to exist in any form, I realize many back home have either forgotten or never cared enough to learn

I am looking forward to presenting research on Sportswashing with John Holden at Managing Sport SIG, today at 4:00 PM Florenz time. If you are at the conference, please come join us in D6, Rm 114. It’s better than being outside in this afternoon heat. 😀

I will reserve judgment here until anything is published. Simply stated, in my view. there are certain companies that offer what they claim to be “fantasy sports” games that are illegal gambling. But that absolutely does not mean all online fantasy sports games in CA are illegal.

Q: Marc, what’s your key takeaway from the so-called #NIL lawsuit between University of Wisconsin and Miami? A: I have long said that #NCAA power football conferences are made up of colleges that compete for services of revenue-generating athletes. This lawsuit evidences that.

Very much enjoyed discussing House v NCAA earlier today on a panel with Kenneth Jacobsen, Jodi Balsam and Michael McCann. It was one of the highest level conversations I’ve seen on this topic since Judge Wilken issued her ruling last month.

First two CSC lawyers are from the only US sports league that arguably doesn’t have to worry about antitrust compliance. CSC’s biggest challenge in my mind: #antitrust.

Friendly reminder that all of these #NCAA issues could be addressed, peacefully and with legal certainty, outside of court, through voluntary, multi-employer, collective bargaining. And, yes, Power 4 college basketball players almost certainly constitute “employees.”

It seemed like a good time to post my forthcoming law review article, "Exploring the Transgender Question in U.S. Segregated Sports and the Future of Title IX." The article, hyperlinked below, is co-authored with Amanda Siegrist. papers.ssrn.com/sol3/papers.cf…

With the Supreme Court deciding today to hear this issue, I suppose my forthcoming #TitleIX article (hyperlink below) may have just become more interesting to some:

I have no idea if Thomas Friedman is correct here, but his criticisms of the Big, Beautiful Bill are organized, logical, grounded in capitalism, and easy to follow. At a minimum, we should be taking his concerns very seriously.

I just read the California AG's opinion on daily fantasy sports. At a later date, I may delve into the full substance. But, in short, companies that insisted on against-the-house pick'em games may have killed the #DFS industry's golden goose by weakening the broader claim.
