Prof. Tibbs compared the legal system to being a stockbroker, esp. with the inherent uncertainty and the constant innovation.

Trend trading: "Follow the trend until the bend at the end."

Judge Colvin responded: "A bend in the road is not an end of the road unless you fail to make the turn."

Prof. Tibbs suggests that defense counsel needs to rethink traditional practice rules, like advising defendants against taking the stand.

He says that this is particularly important because the trends in criminal law have traditionally hovered between overt and covert racism.

Traditional changes to criminal procedure have been "more heartwarming than helpful."

Judge Colvin suggests that the real criminal justice revolution has to start by asking "Who are we?" and "What do we value?"

She says that until we answer those questions, we can't honestly answer the issues that come up in the criminal justice system.

"Everybody has a cause in this revolution."

"If everybody is answering the questions, you have less of a problem."
