Glad to see Noah Feldman arguing this point: the Alien Enemies Act proclamation is internally contradictory. It declares both that Tren de Aragua is a government because it's an arm of Maduro, and also because it governs in areas where Maduro does not. Both can't be true.

I had an extremely interesting conversation with Noah Feldman for Lawfare about why Noah thinks the Supreme Court is playing the "long game" when it comes to decisions like the one limiting universal injunctions. Recommend a listen.

On Lawfare Daily, Alan Rozenshtein spoke to Noah Feldman about his argument that the Supreme Court's primary job in the Trump era is to protect the rule of law by avoiding a direct constitutional crisis with the executive branch that the judiciary is likely to lose.
