I hope and expect that #SCOTUS will disapprove the administration’s unauthorized (and foolish) tariffs. I also urge citizens to distrust commentators who suggest that the “conservative” justices act out of loyalty to the President while the “liberal” justices just do law.

Like Prof. McConnell, I think the tariffs are unauthorized, and also that those who flog the “conservative Court” narrative should say whether they think the “liberal” justices’ votes would be different if the previous president had imposed them. politico.com/news/magazine/…

Because Prof. Vermeule blocks me, I cannot quote or share his misguided critique of Justice Barrett’s remarks (see below). It is clear, though, that many among his followers (a) misuse “positivism” and (b) fail to distinguish between the legislative and the judicial roles.

A fascinating opinion (respecting a cert. denial) from Justices Gorsuch and Thomas regarding the "Indian Commerce Clause" and the "plenary power" doctrine: supremecourt.gov/opinions/25pdf…

Jonathan H. Adler I read many hundreds of petitions that "presented the question" whether chem-trails had been created by the Federal Reserve to disable the satellite TV of the petitioner. The Court didn't, though, "consider" that question.

Sen. Cruz is correct; Tucker Carlson is a repulsive anti-semite, who evidently knows little of Christianity or Judaism, which does not claim "blood superiority" and affirms persons' equal human dignity. Carlson is irritated, I guess, that Jews also affirm their right to exist.
