Their position is that while reducing the tax burden on low-income earners, OUC suggests expanding this to expose public servants earning more than KSh. 10,000 to taxation and advocates for reviewing the PAYE tax band as per the MTRS.

Regarding provision on Advance Pricing Agreements - APA, OUC supports APAs for resolving transfer pricing disputes proactively but recommends early regulation development, KRA officer training, and publication of APAs for transparency and accountability.

They have opposed Clause 27 & 28 (Special Economic Zones and Nairobi Financial Centre tax rates which Introduces reduced tax rates for qualifying investments.

OUC argues this sets a dangerous precedent that could lead to tax evasion, unnecessary revenue loss, and concentration of economic power

They have also opposed Clause 36 (VAT First Schedule Changes) which Proposes classifying certain goods as exempt (currently zero-rated) by deleting specific paragraphs from Part A of the Second Schedule (e.g., raw materials for pharmaceutical manufacturing, animal feed production

, sugarcane transportation, locally assembled mobile phones, solar and lithium-ion batteries). This argue this would subject them to 16% VAT, potentially increasing production costs and burdens on consumers. OUC objects, suggesting a clear policy framework for tax incentives.

They have also commented on the proposal to Introduce a 25-35% excise duty on imported materials like plastic films, float glass, and printed packaging not from EAC states.

OUC recommends maintaining the current 20% excise duty, citing risks of inflation, stifling manufacturing, and increased consumer goods prices.

On Clause 52 (Amends section 51) which seek to delete subsection 1B of Section 59A, which bars KRA from requiring integration or data sharing on trade secrets and private/personal customer data. OUC strongly advocates for retaining this subsection.

They argue that its deletion is unconstitutional and violates the right to privacy and the Data Protection Act, 2019.

With regards to Clause 59 (Misc. Fees & Levies amendment) which seeks to reduce export levy from 17.5% to 10% on steel products and hot-rolled rods, OUC argues that while appearing positive, it put to question the position of local companies

They suggest that such a levy should ideally be on finished goods not used as inputs in other sectors unless locally available.
