The final text of the new Product Liability Directive was adopted by the European Parliament last week. The new directive brings significant improvements compared to the old product liability Directive that has been in place since 1985. europarl.europa.eu/doceo/document…

These improvements include enhanced disclosure obligations for defendants, recognition of data loss or corruption as compensable damages and expanded coverage to include software as a product. Moreover, the directive imposes obligations on service providers as economic operators.

These enhancements signify a claimant-friendly approach that emphasizes consumer protection rights, aligning with the circular economy strategy adopted by the EU.
