I appreciate J. Willett amplifying the arguments in the article. Wish it were an opinion denying QI though. And even if CA5 can’t discard QI on its own, it can revisit some of its quirky precedent. E.g., it’s an affirmative defense - why put the burden of disproving it on plffs?
