In my senior thesis in college I referred to Randolph Bourne and Charles Steinmetz as “fellow hunchbacks.” In the 28th reprinting of my thesis, due out in May, I have changed this to “fellow intellectuals and social critics.”

Word comes that my friend and law school professor, Jay Pottenger, has died. Jay was my supervising attorney at Yale Law School when I argued a case before the Second Circuit in 1987. He was a wise and compassionate man and a true teacher. I will really miss him. Ave atque vale.

An admissions preference for the wealthy would be as grotesque as a preference for whites, wouldn’t it? If so, wouldn’t the logic of reverse discrimination rule out a preference for the socioeconomically disadvantaged? If not, why should race be different?

Defenders of today’s decision in 303 Creative should have to explain how the case should come out had the designer declined to provide a website for an interracial straight couple — or for a Black straight couple — on white supremacist grounds.

I’m assuming that, under the logic of 303 Creative, the web designer can also decline to make a website celebrating the marriage of an interracial couple because she opposes that. Or any marriage involving a Jew because she thinks they are sub-human.

I can understand why many people have become skeptical about the veracity of what is said by the government, experts, elites, the media, etc. I just wish they would apply that same skepticism to what is said by cranks, morons, and knaves.

The critical political questions about Israel and Gaza have devolved into bitter disputes about whether media headlines use the proper words and whether university presidents have expressed the appropriate degree of outrage. It’s a sign of how intractable the real problems are.
