The Senate has no power under the Constitution to "dismiss" the articles of impeachment. It must hold trial, and afterwards, vote to either convict or acquit. Pero mukha namang wala talagang pakialam sa Saligang Batas itong si Sen Dela Rosa eh.

The House response was swift, reasonable, and dignified. Maayos, kahit kung tutuusin, binastos sila ng Senado with that insulting and unconstitutional "remand." This restores some sanity to a process that went off the rails after the embarrassing spectacle at the Senate.

She wants the articles of impeachment "dismissed" without going to trial kasi ayaw niyang mailabas at maipakita sa tao ang ebidensiya. Same reason why her Senate allies are so desperate to avoid a trial.

This is correct. The House determines if an impeachable offense has been committed. The matter is then brought to the Senate, which must "forthwith" conduct a trial and vote to convict or acquit. The Senate has no power to review the sufficiency of charges and order a dismissal.

Malinaw naman talaga ang Konstitusyon eh: The Senate has to "try and decide," meaning receive evidence and then vote to convict or acquit. Escudero, et al are just insisting on a strained interpretation for their own political ends.

Cong Leila de Lima is absolutely correct. The House initiates impeachment. The Senate tries and decides, "forthwith." Two co-equal bodies performing their respective tasks. The Senate does not "check" what the House has already decided. Ano to, homework?
