There is no rule that you need to do nation building after winning a war, especially one fought largely by air. See Serbia/Bosnia/Croatia etc

No, it's because it was universally understood at the passage of the 14th Amendment that the tribes, holding an anomalous position in American law as separate domestic sovereigns, were not included in the Citizenship Clause.
