Bottom line for collectives after the revised CSC guidance: You need to attempt to make a profit from the sale of goods/services. And then (a) utilize an athlete’s NIL in the goods/services (ex: tshirts/merch) and/or (b) use the athlete’s NIL to promote the goods/services.

It’s actually comical at this point. We can publicly label it “NIL” all we want, and we can put language in contracts that says “this-isn’t-pay-for-play,” but at the end of the day, they are playing contracts.

The statement is missing some info, so I added it here in parentheses.🫡 “Pay-for-play will not be permitted (unless paid for by schools), and every NIL deal done with a student-athlete must be a legitimate NIL deal, not pay-for-play in disguise (except for deals with schools).”

Have to agree with this. Do we really think the fed govt will effectively regulate whether third party NIL deals are “pay for play”? Or that it even should? College athletics doesn’t need more rules. It needs to agree to rules with athletes so they’re actually legal.
