We are particularly pleased to hear the Committee cite the “inspirational” role of Mary Robinson in the area of legal aid in Ireland. They also highlighted the legacy of the “groundbreaking” Airey v Ireland case.

The Committee has now questioned the State about the absence of recognition of “intersectional” discrimination in Irish law. FLAC has recommended that the legislation which will prohibit intersectional discrimination should be advanced urgently.

The Committee has expressed concern at the fact that the Legal Aid Board cannot provide representation before the tribunals such as the WRC and social welfare appeals office.

CEDAW has noted its concerns around the strict means test for access to civil legal aid, including the application of the means test in cases concerning child maintenance.

CEDAW has highlighted the emphasis on mediation in the Family Courts Bill and the risks for women’s rights where there is a power imbalance in the mediation process.

Finally, the Committee has noted the need for urgent measures to promote access to justice for people with disabilities.
