The Supreme Court in cases like Loper Bright (overturning the Chevron Doctrine), West Virginia v EPA, Michigan v EPA. etc., made it crystal clear that agencies like EPA don’t get to creatively declare our own new laws and assume massive powers where gaps exist in federal statute.
