A judgment that may be of significance to those who make grandiose claims about the reach of Article 8 in equality law.

The Good Law Project's statement of grounds against the EHRC actually cites cases from 1996 and 2005 as "historical context" for a 1992 Act. And clearly not read para 38 FWS1 which ruled these cases are not the authority for trans having the PC of the sex in which they present.

🧵(Another) thread on Police Scotland's transgender search policy. Nearly a decade ago the Scottish Parliament passed the Criminal Justice (Scotland) 2016 Act. After a drawn-out controversy, the Act put the use of stop and search in Scotland onto a statutory-only basis.
