Which university or collective will be the first to pursue litigation (e.g., tortious interference with contractual relations) against a departing athlete or another school's collective? Wrote about this possibility for BYU Law Review: papers.ssrn.com/sol3/papers.cf…

This!đź”˝ Recently advised an athlete who has technically exhausted eligibility (but with some extenuating circumstances) to do the same as there isn't downside while awaiting decisions by NCAA & courts.

NEWS: Arkansas's NIL collective has sent two demand letters to players asking to fulfill buyout clauses, source tells Front Office Sports. The AD's comments yesterday were referring to multiple players who left before NIL contracts expired, including Madden Iamaleava. frontofficesports.com/will-arkansas-…

Well, that's that. Looks like South Dakota got some help for the downstream D1 schools (and some concessions for their own schools as well).

Regardless of whether you agree with their decisions/actions, Claudia Wilken is right up there with folks like Walter Byers as far as individuals who've shaped college athletics...

I continue to be struck by the position that the House defendants put coaches, athletics admins, & athletes in by not phasing/grandfathering in roster limits. Seemed like such low-hanging fruit all along when Judge Wilken started expressing concerns responsive to the objections.

And between the portal window being open, the potential elimination/changes to hundreds of NCAA rules, and last night's House news, buy your local friendly compliance person a coffee on the way in today...

The COI reminding everyone of its presence, releasing four cases involving DI schools already this month - first time that's happened in four years! Three cases involve impermissible sports gambling, two include recruiting violations, and one involved improper certification.

We have our the first decision in the flurry of lawsuits filed by pre-2016 athletes over the NCAA and conferences' use of their NIL rights. A NY federal district court judge has dismissed a lawsuit led by ex-Kansas basketball player Mario Chalmers, finding the suit untimely.

Thanks to the fantastic editors Fordham Law Review for their efforts on my online piece analyzing the NCAA's responsiveness to coaches' concerns regarding "tampering" with athletes on their rosters (feedback welcome!): papers.ssrn.com/sol3/papers.cf….

Some speculating here, but Judge Wilken will likely rule on whether to approve the revised House v. NCAA settlement before the end of May. This will give schools time to prepare for July 1, the date schools have planned to start directly paying athletes. I think Judge Wilken

That first point is great in theory but also means the school can't automatically file a lawsuit or run to the state AG whenever that governing body makes a decision with which the school disagrees or that's negative to its position.

In a stunning move, the power conferences have drafted a contract that would bind schools to new enforcement rules & require them to waive the right to sue over decisions, sources tell Yahoo Sports. Schools not signing may risk conference eviction - bit.ly/3ZofxOA
