This is an excellent new article by Joshua Paine and Liz Sheargold, proposing a combination of a climate change carve-out to IIAs and new procedural rules to safeguard policy space.
#OECD #investment treaty conference: Liz Sheargold distinguishes treaty carve outs excluding jurisdiction & exceptions like one mangled by tribunal in #EcoOro. Worth trying carve outs but not 100% persuaded arbitrators would respect them. Wolfgang Alschner

Nice piece by Liz Sheargold & Joshua Paine. Bottom line, via Jonathan Bonnitcha, procedure/substance distinction unstable if not illusory. Certainly, all issues re *competences* of tribunals,jurisdiction ratione materiae remedial powers, within 4 corners of UNCITRAL WGIII mandate. 1/2
A short piece by Joshua Paine and I about how regulatory chill found it’s way into UNCITRAL WG III’s mandate, and the interesting right to regulate clauses in Draft Provisions on Cross-Cutting Issues, esp a proposed broad ISDS/SSDS carve-out for public interest measures.
