For everyone who has been waiting so patiently for it, the USMCA panel report in the Mexico - GE Corn case is now out: ustr.gov/sites/default/… The Panel found a number of violations, and also found that these violations were not justified under the exceptions.

Bremmer-Sullivan exit interview is worthwhile. I dwelled on tone deafness of US allies. Practice diverts from theory if you examine the EU ramp-up ACI to counter US coercion; costs to other open markets of US industrial policies; the increased closure of US markets to ROW firms.

Smart take here from Simon Lester on Sullivan's legacy. Share his critique of Sullivan as to how he promotes ideas as norms: "foreign policy middle class" or "dangerous dependencies" without defining them, setting their scope, or clarifying what concepts they relate to (or replace).

Some business groups were concerned about USTR renegotiating investment protection provisions. USTR just released an FTC Decision under the US-Colombia TPA, and if this is all USTR was doing, it doesn't look like a big change to me. ustr.gov/about-us/polic…

To make sure my IELP blog following never gets too big, I try to do occasional posts on obscure topics such as "optimal tariffs" to scare off the general public: "The Optimal Tariff Argument at the Scott Bessent Hearing" ielp.worldtradelaw.net/2025/01/the-op…

One common trade policy misconception is that we had anything close to free trade with China. Yes, China joined the WTO, but loads of tariffs, non-tariff barriers, and subsidies remained in place.

From an amicus brief in one of the IEEPA cases: "[IEEPA] is silent on tariffs, and for good reason. It was never meant, and has never been understood, to authorize the President to impose them. Still less does it permit the Executive to restructure the nation’s trade regime."

Lean into the history, & inevitably, we can learn about where to go. History highlights the limitations of existing rules in the current context; nevertheless, there remains a thread that connects us to today, helping us better implement procedures & imagine new rules (new paper)
