Russell O'Connor Nicola Jayne GB News SDLT is a self-assessment tax. Irrespective of whatever advice you receive, you are ultimately liable to ensure that you're paying the correct amount of it. What she did was tax evasion.

Dan Neidle Dan, all I can say having referred several people I know to professional entities better placed to deal with SDLT than me is that either she didn't declare everything or she was negligent. Reckless is the bare minimum I'd expect from HMRC.

The Jackalโ€ฆ Simon Knight Angela Rayner Keir Starmer mitigating the 3% add SDLT involves forming a trust & importantly avoiding any rights to occupy it - it would have been explained very carefully by those who know what they are doing - she either ignored it or messed up the steps - lawyers giving advice not the same as conveyance

But the idea that she deliberately decided to not pay the SDLT makes no sense to me. I believe that she thought the higher rate didn't apply.

Richard Neilson ๐Ÿ‡ฌ๐Ÿ‡ง ๐Ÿ‡บ๐Ÿ‡ธ ๐Ÿ‡ฎ๐Ÿ‡ฑ๐Ÿšœ coal collector Jason McAuney Simon Danczuk Grumpy_Arse I believe Shoosmiths are still in place re the Trust. It's perfectly normal to use different solicitors for different legal matters. The conveyancing solicitors haven't proved they didn't discuss SDLT. They've just said they don't give tax advice.

Garth Gibbins George Rosenberg It's just Paul Alexander Thomson Dan Neidle She is a trustee of the trust she sold property equity to. The nuances around that sale are way more complex than this SDLT issue on the Hove property. No way she was unaware or had not been advised before of the circumstances around the trust and the property.

Miriam Cates Only theyโ€™ve come out today and said they didnโ€™t advise her on SDLT Miriam. You must keep up less you look redundant and agenderised.

James (@notime2heel) 's Twitter Profile Photo

Scout1967 Sky News Beth Rigby Basically she withheld information from the conveyancer to illicit an SDLT calculation that did not apply to her circumstance. She's done this sort of behaviour before, and before she got away with it. This time, she's been caught red-handed. That's really what this is.

The Log Lady (@gamecounsel) 's Twitter Profile Photo

AnlabyJools Simon Danczuk Grumpy_Arse It has everything to do with Trusts. The Trust is the reason she got slammed about the SDLT. Without the Trust, the flat would've been deemed her only property & none of this would've happened.

Peter Stefanovic TBH I think this post does you more harm than provided support for her! Any person buying a second home knows about higher SDLT! You can claim it back if you sell your other (first) home within 3 years and Iโ€™m no tax expert!

Bruno Shanklin Kiran Stacey The conveyancer's statement is authentic, as reported by the Guardian, BBC, and Daily Mail. Verrico & Associates confirmed they don't handle trusts or tax advice, and calculated SDLT using HMRC's tool based on info Rayner provided. She admitted underpaying ~ยฃ40k due to a trust

Tracey Williamson 4th July - Tory wipe Out Simon Cook SaresPage ๐Ÿฆ‹๐Ÿฆ‹ Jeremy complied with tax law, if not his Commons interests register. Angela didnโ€™t. I concur that the rules are needlessly complicated and designed to catch people out. However, you canโ€™t push for SDLT rises, property tax rises, wealth taxesโ€ฆ.and not pay them yourself.

However, Rayner's purchase of the Brighton flat triggered the 3% surcharge due to her prior ownership and transaction details, which she paid after self-reporting (per BBC

Henry Carter Dan Neidle Rayner was still insisting she only owns one property during her Sky interview. For SDLT purposes, she owns two - though likely failed to disclose that.

Oh Winston ๐Ÿ‡ฌ๐Ÿ‡ง Andrew Pierce Yes, vulnerable person trusts for disabled beneficiaries can qualify for special SDLT treatment, often avoiding the 3% surcharge if the trust owns the property outright and meets HMRC criteria (e.g., bare trusts where the beneficiary is treated as owner). Dominic Ahern Dan Neidle It's not clear. But it's impossible to act on a property purchase without considering SDLT liability. All I'm saying is, there must've been some sort of discussion. It seems they've breached client confidentiality anyway, so who knows what else will be revealed?

Oh Winston ๐Ÿ‡ฌ๐Ÿ‡ง Andrew Pierce UK SDLT rules include provisions for "vulnerable person trusts" (e.g., for disabled children), which can qualify for special tax treatment, potentially avoiding the higher rate surcharge if the trust owns the property outright and meets criteria (per HMRC and FT reports). Raynerโ€™s in the shit for an extra ยฃ40k of SDLT on a flat she bought to look after her disabled son. Zahawi was sacked because he failed disclose HMRC were investigating him for ยฃ5,000,000 in unpaid tax. And he claimed parliamentary expenses to heat his fucking stables.
